Children’s Maintenance Fund

Children’s Maintenance Fund (CMF) – state monetary funds from which payments are allocated to children who, in accordance with the decision of the court or with the Child’s (children’s) Maintenance Contract confirmed by the court, do not receive the established maintenance or part of the established maintenance imposed on the child’s parent (parents). It is established that the maintenance shall be paid in monthly periodic payments.

 

CMF is administered by the Administration of Children’s Maintenance Fund under the Ministry of Social Security and Labour (ACMF).

 

Who has the right to apply?

 

One of the parents with whom the child lives in accordance with the decision of the court or a child’s guardian (custodian) decided upon by the court permanently residing in the Republic of Lithuania (i.e. citizens of the Republic of Lithuania, whose data on the permanent place of residence in the Republic of Lithuania, if no permanent place of residence – on the municipality of their domicile, are entered into the Population Registry of the Republic of Lithuania or foreigners permanently residing in the Republic of Lithuania) have the right to apply to the ACMF for CMF.

 

Who is entitled to the maintenance payment?

 

A child – a person under 18 year of age who is permanently residing in the Republic of Lithuania as well as a disabled person over 18 years of age who became disabled before turning 18 years of age and who does not receive the maintenance or part of maintenance established in accordance with the decision of the court or with the Child’s (children’s) Maintenance Contract confirmed by the court imposed on one or both parents of the child.

 

To what amount of maintenance a person is entitled to?

 

The maintenance allocated from CMF shall not exceed 1.5 Basic Social Benefit (at present it is 57 EUR) for one child per month. The exact amount of maintenance payment is calculated in accordance with the order set out in the Law on Children’s Maintenance Fund of the Republic of Lithuania.

 

The order of debt recovery

 

The debtor is informed that the State undertakes debtor’s obligation to make payments to maintain the child and will seek, according to the method established by law, to recover amount allocated from CMF and 5 percent of annual interest calculated from the amounts paid to full recovery from the debtor. If the permanent place of residence of the debtor is unknown, information on the decision made by the ACMF is published in the Official Gazette (Valstybės žinios) not later than within 20 working days from the day the decision was made.
